how do I find out who has ownership?
« on: March 13, 2012, 08:31:51 am »
I apologise if I'm asking this question in the wrong section. There is a small patch of land ( no more than 1 1/2) next door to our place. There are a possible 3 party's that might own it, but none seem to know for shore ( which  seems odd, not knowing how much land you own, Maybe that's just me who hasn't got any ::)). So Just in case the opportunity came along that I could make someone an offer for the unused patch of land, how do I go about finding out who owns it? ??? Any help would be great. I'm in Scotland if that makes a difference.

I'm in the same predicament  but it means taking land back off a previous neighbour if my architect is right that it's mine so I've put my lawyer onto it.  Worth the money.

The Land Register lists all land in Scotland but if it's part of old deeds it may not show separately - the Register of Sasines is the previous holder of lists of title to land, so you might have to look there.  Lawyers have access to this but I'm not sure if lay people have.

This link explains it http://landregistryservice.co.uk/

yes lay people can get access but it costs money      the solicitors just employ searchers that is there profession
if the land or neighbouring land has been sold recently it will be in new form some areas did this anyway
DO NOT TRUST THIS NEW FORM OF MAPS THAT IS ISSUED FROM ORDANCE SURVEY THEY ARE INANDATED WITH ERRORS
a friend sold his house last year no change in the title from his purchase yet o/s had his boundary as the middle of the road and part of a field it cost him £700 for a surveyor and a four month delay on completion and o/s would not compensate
far better using the old maps that are lodged backed up with written title
the cheapest option is as Sylvia says start using it     every bit of land in Scotland is owned by somebody it is just finding that person  and it is just not as simple as using the land to claim title you can use it for up to ten years and the original owner can still turn you out :farmer:

Thanks for all the advice. Defiantly can't start using it as one of the could be owners is my employer and land lord.  Which is how I know there are 3 possible owners and that none actually know if they do or don't own the land.

Would any of them mind you putting it to some use?  Would they share any rent or payback?
