Hi, Got myself in trouble with DEFRA on animal movement breech, not sure of the outcome so are quite worried about it. Moved 3 weaners onto holding, when collected and loaded the chap I bought them from said he had had trouble with the EAML and gave me an AML to cover me during transit (11-11-12) On the 13-11-12 he sent me an EAML dated the 13-11-12 witch I completed on line. On the 17/11, 2 sheep were moved off, tupping completed and on the 17-11-12 moved 5 lambs off to winter grazing. I know this is serious but It didnt even enter my head that this was into the 6 day rule. If we had completed the correct EAML on the day of the movement would this have been OK? I have to ring DEFRA back, I dont want to drop in chap I bought the pigs from. Not sure what to say to DEFRA. Any thoughts? please dont shout at me.

So they were moved on on the 11th and the new stock moved off on the 17th?
The standstill period does not include the day of the event ... so 6 day standstill after the 11th means you can't move stuff off until the 18th.

If you think of it this way - there needs to be 6 days of stock standstill which is 144 hours.  The last possible movement on the 11th would be at 23:59 (say).  So 23:59 on the 11th + 144 hours is 23:59 on the 17th ... which is in effect the 18th.

 I agree - front it up, apologise and assure them it will never happen again. I would doubt if they will pursue it but they may come and visit, so have everything in good order.

I doubt they will take if further, if they chased everyone who made a error they would not have time for anything. As it is they won't even take action for someone who was caught moving a whole lorry of pigs without movement forms, all they got was a slap on the wrist. So i agree with the rest, tell the truth, apologise and say it was a genuine mistake. I been sent threatening letters when I failed to send back a copy of the movement form (in the paper days) but its all hot air. i apologise and nothing more was said.

foobar - for info the standstill is in article 4 of the Disease Control Order 2003  this states
 
"No person shall move any sheep, goats or cattle from any premises if any sheep, goats, cattle or pigs have been moved on to those premises during the previous 6 days."
 
ie the standstill is a clear 6 days.
 
ditto 20 days for pigs.
 
RonMinch - Am amazed that TS picked this up - they are not usuaully that good at entering the data for sheep. As others suggested I would say that they moved on the 11th, better to argue that you have not created any health risk than to cover documentation errors.

My point was trying to illustrate that the move-on day can't possibly be included in the 6-day period.  The way I remember it is if I moved on on a Tuesday then I can't move off until the following Tuesday.

I suspect that now that pig movements are electronic they are able to hook that into the manual sheep system much easier and the computer just flags up the error.

Thanks for the replys, I noticed that I put the wrong date in my first post the 5 lambs moved off on the 18-11 not the 17th even more mistakes! . Any way will ring them tomorrow and admit my mistake and say how sorry I am. If any one is interested I will post an update when I get a response. Fingers crossed   a slap on the wrist.  Ron
