Land being waterlogged?

Hi, our  boundary is defined by a stream with a footpath on our side which then is fenced.
There is an old pit / mine near which is being pumped out and flooding the path and our land so all the posts are prematurely rotting.
What actions can I take to stop or control the pumping of the pit which is making the path unusable and rotting my posts?

 Contact the Environment Agency.
 Sounds like pollution, which is illegal.
 If it were me I would greatly exaggerate the problem - ie acidic water, horrible smell, possibly toxic (which water from mine workings normally is.) That way, and seeing as the weather's good now, you might be lucky enough for one of them to fancy a day out and actually investigate.

It seems like an iron ore build up in the beck which doesn't help, we used to try and clear this but it really needs a digger in to make it bigger or slow the pumping rate down.
