Does any one know anything about changing the compensation agreement for poles on your land with the electrcity company. Last year we signed a wayleave agreement with scottish power and get about £90 a year in compensation for about 4 poles and a small tower. We were apporached by a guy cold-calling from a company that specialise in negotiating compensation for such structures and he explained that we could change the temporary annual agreement that we have into a permennt agreement and a one-off compensation payment that may be as much as 30-40 thousand pounds! but they would take 20% of that as their fee. My solicitor said that she would do it for much less! however she was cautious that we may leave our selves open for the electricity company to erect what ever athey want on our land in the future without further compensation or agreement. I just noticed our agreement is with scottish power and not national grid so presumably that rules out them sneeking in a national grid pylon in the future - I'm a bit concerned as there is talk of putting another national grid line across Anglesey in the future to service the proposed Wylfa B nuclear power station, and the multitude of other alternative generating plants that are proposed here.


What i'm intrested in is knowing has anyone any experience of negotiating a deed of easment with power companies for poles or other equipment on their land?

I haven't got an answer to your question , but I do have a leccy pole on my land that I get the huge sum of £7 a year for . A sum that 'they' decided they would pay me for the rent of 'my' land ...mmmm
 I have left this for some time now and it has bubbled and festered quietly on simmer.
But now I have decided that 'I' will decide how much rent someone pays to me for the use of 'my' land ...NOT the other way round.
So I am going to tell them to remove their pole unless they pay me a LOT more money , and if they won't remove it ...I will ....
 It sounds from reading the above that I will be stroppy with them , but I won't at all , unless they refuse to move the pole and also refuse to pay more money . Then if they refuse to move it .. as I say I will ...simples ....
The thing that really narked me , was that when I asked if I could have leccy put on my land they said yes ..it will cost £4,000  :o :o :o mmm move your pole please ... or pay me £3,000 a year rent  !!! I think they will move the pole .

trefnantback  you can deal direct with the electricity company this is called commuting your annually payment into one sum the cold caller is at it as is your legal adviser but if you insist on being represented unnecessarily i will do it for 10% if as you suspect you are going to be on a good thing with future wayleaves you could do as the farmers that have gas pipes through there land do get a land agent they are paid for by the utility company's and act on your best interest and are paid for by the utility company's COMUTING THIS POWER LINE DOES NOT ALLOW THEM TO ERECT OTHERS
RUSTYME the rent you get for the pole has been agreed with the nfu  and either you or the previous owner agreed to the installation of it that was the time to negotiate the cost of your electricity supply i have heard of sums double your quotation and more  if you want electricity it is easier and cheaper with direct access to a line(if the pole is moved it has to go on somebody's land and they might not be as accommodating as yourself to enable you get a supply) as to moving the pole yourself DONT they will bill you and have the right to claim costs plus they will move the pole and again you pay if they have a wayleave signed by you or the previous owner

                the NFU neither own my land or act on my behalf . They may well act or speak on behalf of their members , but I am not , nor have I even been a member , therefore any agreements they may or may not have with any private company don't apply to me , or my land .
 However, the pole was on my land when I bought it , and yes I did (I think ? ) sign their wayleave when I signed other docs at time of purchase . 
I will not be going in guns blazing 'telling ' them to shift their pole or else !! but will be asking them if they can move their pole 'please' , pretty please even .
It will only be if they don't, that I would then tell them to shift it , and if they still don't then I will ... full stop  !!!
 I can't see why it would come to that though ... but if it does  .. there you go !!
 The quotation I got was some time ago now , and it was only that price IF they could do the supply without having to put in place a transformer , it would then cost another £15-20,000 plus £1500 for another pole !!!
 As it was never my intention to have leccy put on anyway ( I only asked because someone else wanted it on , family member long story !!) , I didn't take it any further .
  Come what may the pole will go !!!

Our neighbours have tried this and were told a) it will be very expensive to move (they also have the transformer for our hamlet on it) and b) as this is not a necessary job they would do it at their leisure, so it would take years.... Our neighbours haven't gone back to discuss it....

Rustyme, read the wayleave.

By entering into the wayleave you or your predecessor as owner has agreed for the power company to put their pole on your land and run a cable over it and have access to it across your land.  This may be for a very long period of time in which case you are stuck with it cos if they don't want to move it they don't have to. 

So read the paperwork first. 

We've got the high pressure oil pipeline that runs from The Wash via various airports including Luton and Heathrow.  From here the next stop is Buncefield, about 5 miles away which spectacularly blew up a few years ago. We have obligations not to dig without telling Total but get no money: our predecessor trousered that.   Total used to be quite good but have now farmed out the management which is now utter heavy-handed shite.

Don't do it Rusty....we can't all come visit you in jail! Rest assured though, that is where you will go. You will, no doubt, be charged with criminal damage.....and they will make an example of you.

Stand up for what you believe in m8, but don't go down for a poxy telegraph pole. I for one would miss you

And as I said before, Russ, it is dangerous to take a pole down - they have electricity lines attached to them, pal  ;) ;D

 I may wait and see what happens on 21st dec 2012 .... if I wake up on the 22nd and nobody else does ... i'll chop the bugger down !!!
